What is RUFADAA?

RUFADAA, the Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA) is a U.S. law that allows a person’s fiduciary—like an executor or trustee—to access their digital assets after death or incapacitation. RUFADAA helps fiduciaries manage these assets, which can be difficult to access due to privacy rules and platform terms of service.

One feature is that RUFADAA creates a clear process for this access. First, it looks at any instructions the person left using an online tool (like Eternal Me). If there are no instructions, the fiduciary follows directions in the person’s will or other estate planning documents. If neither exists, the terms of service for the account apply.

This law helps balance privacy with the need to manage digital assets. It gives fiduciaries a way to handle online accounts and property, while making sure the person's wishes are respected. Most U.S. states have adopted RUFADAA, making it an important tool for estate planning.
